By means of this Privacy Policy, we commit to protecting your privacy and personal information that has been shared with us on the LIFE COACH BARB Platform. Any Service availed by “You” through the LIFE COACH BARB Platform is subject to this Privacy Policy and our Terms and Conditions. Any term used but not defined in this Privacy Policy shall have the meaning attributed to it in our Terms and Conditions.

By using the Services or by otherwise giving us your Information, you will be deemed to have Read, Understood and Agreed to the Practices and Policies outlined in this Privacy Policy and agree to be bound by the Privacy Policy. Information you provide to us. We may collect the information you provide to us directly – for example, when you create a User Account, submit feedback, answer research questions, or interact with LIFE COACH BARB customer support services. This includes contact information, such as name, home and billing address, email address, and telephone number; demographic information such as date of birth, gender, race/ethnicity; payment details like billing address and credit or debit card number (for payment purposes only); identity-verification information; health-related information, such as information about your medical history, medical conditions, treatment options, physician referrals, prescriptions, lab results, lifestyle, and personal preferences, or other related health information, such as your physical and emotional characteristics; other information, such as, audio, images, and video of you; log-in credentials (if you have a User Account); and any other information you choose to provide to us about yourself or others. Note: if you choose to allow other apps on your device to share information with our Services, we may collect information from those other apps (for example, photos, health information, and/or audio clips). 

Information about your use of the Services. We may collect information related to your use of and interaction with the Services, such as communications with Practitioners through the Services, Audio/Video communication and meetings with the Practitioners, whether you are a current User, a Practitioner, User Materials, and information related to your inquiries or requests. It shall be noted that such Audio/Video communication may be shared with the Users, Clients or Practitioner on their request by LIFE COACH BARB.

 Information we collect automatically. When you interact with the Services, we may automatically collect information such as traffic data, logs, referring/exit pages, web page requests, location data, frequency and/or date and time of your activities on the Services, error information, clickstream data, IP address, usage data, and information about your Internet connection, device (such as a mobile device ID), connection speed, operating system, and/or browser. We may also collect information about your online activities over time and across third-party websites or other online services. Some of this data is collected using cookies and similar technologies.

Information we receive from social media services and other sources. We may collect information about you if you use any of the other websites we operate or the other services we provide. We may collect information from public sources, advertisers, partners, and other third parties (such as third party intermediaries, including Practitioners). We may also collect information about you through a social media or other third-party account, such as Facebook or Google (each, a “Third-Party Account”). For example, if you access the Services or create a User Account through a Third-Party Account, you may allow us to have access to certain information in your Third-Party Account. This may include your name, profile picture, gender, networks, user IDs, list of friends, location, date of birth, email address, photos, videos, people you follow and/or who follow you, and/or your posts or “likes.” Social media sites and other third-party sites, such as Facebook and Google, have their own policies for handling your information. For a description of how these sites may use and disclose your information, including any information you make public, please consult the sites’ privacy policies. We have no control over how any third-party site uses or discloses the personal information it collects about you. We may combine information we receive from social media services and other sources with other information we collect from and about you.

3. HOW DO WE USE YOUR INFORMATION?

LIFE COACH BARB may use information collected under Clause 1 above for the following purposes:

 In order to provide a personalized browsing experience, LIFE COACH BARB may use your Personal Information to improve its marketing and promotional efforts, analyze usage, improve the content of LIFE COACH BARB, product offerings, and customize LIFE COACH BARB’ content, layout, and services, in order to improve LIFE COACH BARB with a view to optimizing LIFE COACH BARB for you and better tailor it to meet your needs.

We may share Personal Information (including but not limited to, information from cookies, log files, device identifiers, location data, and usage data) with businesses that are legally part of the same group of companies that LIFE COACH BARB is part of, or that become part of that group ("Affiliates"). Please note that if you delete your User Account, Service providers, including Practitioners, and other affiliates may still have the right to retain information under applicable law, regulations, or their own retention policy. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. 

 6. WHAT RIGHTS DO YOU GRANT TO US?

For any content that you share on our website’s discussion forum or through other communications with us, that contain Intellectual Property Rights, like photos and videos ("IP Content"), you specifically grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license ("IP License") to use such User Content for the purpose of providing the Services to you. This IP License will end when you delete such IP Content or your User Account. This Clause does not apply to images, videos or other content containing Intellectual Property Rights, shared only with your Expert while availing the Services.

When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be made available to others).

7. WHY DO WE RETAIN YOUR INFORMATION?

Subject to applicable law, all information (and copies thereof) collected by LIFE COACH BARB, including without limitation Personal Information, User Data, and other information related to your access and use of the Services, may be retained by LIFE COACH BARB at least for a period of 7 (seven) years from the date of disclosure by you, including but not limited to, for purposes such as compliance with statutory or legal obligations, tax laws and potential evidentiary purposes in accordance with applicable law and for other reasonable purposes such as to implement, administer, and manage your access and use of our Services, or resolution of any disputes.

 Any information shared by you during personal coaching ("Confidential Information") shall be excluded from the definition of Personal Information and shall not be collected/used in the same manner as Personal Information as mentioned in the above clauses.

Your Confidential Information shall not be disclosed or shared by LIFE COACH BARB, its employees, its agents, or any third-party contractors, including Experts with any third party, either orally or in writing, except in the following circumstances:

If LIFE COACH BARB believes that there is a significant/ real/ imminent threat or risk to your health, safety, or life or to the health, safety, or life of any other person or the public ("Red Flags");

If LIFE COACH BARB is required to share such Confidential Information with any authority by law; and

If you have claimed health care insurance and such Confidential Information is required by the insurer.

In the case of Red Flags, LIFE COACH BARB may share your Confidential Information and Personal Information with your employer, institution, or other entity enabling you to access our Services.

9. IS PERSONAL INFORMATION ABOUT YOU SECURE?

 Please make sure that you maintain the secrecy of your account information. No method of transmitting or storing electronic data is ever completely secure, and we cannot guarantee that such information will never be accessed, used, or released in a manner that is inconsistent with this policy. You are responsible for maintaining the secrecy of your account information at all times.

You are solely responsible for maintaining the confidentiality of your password and user identification to access your User Account ("User Credentials"). You shall be solely responsible for all activities and transmission performed by you through your User Credentials. LIFE COACH BARB assumes no responsibility or liability for your improper use of your Credentials or information contained in your User Account. 

10. THIRD-PARTY SITES. 

The Website may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of LIFE COACH BARB. We are not responsible for the content of any Linked Site, including, without limitation to, any link contained in a Linked Site, or any changes or updates to a Linked Site.

LIFE COACH BARB does not intend the Linked Sites to be referrals to, endorsements of, or affiliations with the linked entities.

On accessing the Linked Sites, you shall be governed by the terms of use, privacy policy and such other additional policies of the Linked Sites. You further acknowledge and agree that LIFE COACH BARB shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, advertising, products, services or other materials available on or through any Linked Sites or for any errors, defamatory content, libel, slander, omissions, falsehoods, obscene content, pornographic material, or any profanity contained therein.

11. WHAT RIGHTS DO YOU HAVE?

Updating and deleting your information: You may request access to your Personal Information and request its update by writing to us at barb@lifecoachbarb.com and we will respond within a reasonable time. If granted by applicable law, you may have the right to seek deletion of your Personal Information in our possession by writing to us. However, if you request deletion of your Personal Information, we will not be able to provide you the Services, as we require access to your information in order to provide you the Services.

When you update information, however, we may maintain a copy of the unrevised information in our records. Please note that some information may remain in our private records after your deletion of such information from your User Account. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.

12. CONFIDENTIALITY AND SECURITY.

Your Personal Information is maintained by LIFE COACH BARB in electronic form on its equipment. Such information may also be converted to physical form from time to time. LIFE COACH BARB takes all necessary precautions to protect your personal information both online and offline, and implements reasonable security practices and measures including certain managerial, technical, operational and physical security control measures that are commensurate with respect to the information being collected and the nature of LIFE COACH BARB’s business. 

No administrator at LIFE COACH BARB will have knowledge of your password. It is important for You to not to share your password with anyone to protect yourself against unauthorized access either through your computer or your mobile phone. Be sure to log off from the Website when finished. LIFE COACH BARB does not undertake any liability for any unauthorized use of your account and password. If you suspect any unauthorized use of your account, you must immediately notify LIFE COACH BARB by sending an email to barb@lifecoachbarb.com You shall be liable to indemnify LIFE COACH BARB due to any loss suffered by it due to such unauthorized use of your account and password.

LIFE COACH BARB makes all User information accessible to its employees, agents or partners and third parties only on a necessity basis and binds only its employees to strict confidentiality obligations.

 Notwithstanding the above, LIFE COACH BARB is not responsible for the confidentiality, security or distribution of your Personal Information by our partners and third parties outside the scope of our agreement with such partners and third parties. Further, LIFE COACH BARB shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of LIFE COACH BARB including but not limited to, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User etc.

13. CHANGE TO PRIVACY POLICY.

LIFE COACH BARB may update this Privacy Policy at any time, with or without advance notice. In the event there are significant changes in the way LIFE COACH BARB treats User’s personally identifiable information, or in the Privacy Policy itself, LIFE COACH BARB will display a notice on the Website or send Users an email, as provided above, so that you may review the changed terms prior to continuing to use the Services. As always, if you object to any of the changes to our terms, and you no longer wish to use the Services, you may contact barb@lifecoachbarb.com to deactivate your account.  If a User uses the Services or accesses the Website after a notice of changes has been sent to such User or published on the Website, such User hereby provides his/her/its consent to the changed terms.
